MENTAL HEALTH
Thursfields has one of the few specialist Mental Health Law
teams practising in the West Midlands. We regularly represent
Clients who have been detained under the Mental Health Act
before the Mental Health Review Tribunal. We can also help
with other aspects of Mental Health Law.
MENTAL HEALTH REVIEW TRIBUNALS & COMPULSORY DETENTION
IN HOSPITAL
If a client is kept in hospital under Section against his
or her will, our dedicated Mental Health Law Department can
help, at short notice if necessary. We will call to see the
client in hospital and discuss the case confidentially. The
client has the right to apply to the independent Mental Health
Review Tribunal which has the power to discharge from hospital.
Our specialist Lawyers regularly represent patients at the
Tribunal and their expertise will ensure that the client’s
wishes are put forward clearly. Our fees for Tribunal representation
are paid by the Legal Services Commission. There is no means
test in Tribunal cases.
COURT OF PROTECTION
If the client or a family member do not have an Enduring Power
of Attorney and then have an incapacitating accident or illness
which leads to inability to deal with financial property or
affairs an application can be made to the Court of Protection.
We can deal with this. The Court of Protection will appoint
a Receiver to deal with your property and affairs. We can
also act as Receiver if required.
PUBLIC GUARDIANSHIP OFFICE EXTERNAL RECEIVER’S
PANEL
The Public Guardianship Office is the administrative office
of the Court of Protection. Thursfields are one of the few
firms in the West Midlands to have two Partners who are members
of their External Receiver’s Panel. This means that
they can be appointed to act as Receivers to administer the
financial affairs of those who do not have family or others
who can take on the role of Receiver.
